The Court held that an amendment to the Act giving the FTC oversight authority over the HISA solved the nondelegation problem with the Authority’s rulemaking power, that the Act did not violate the Due Process Clause, that the Authority was not a government entity subject to the Appointments Clause, and that one of the new plaintiffs did not have standing to bring a Tenth Amendment challenge; but the Court held that the Act’s enforcement provisions violate the private nondelegation doctrine because “[t]he statute empowers the Authority to investigate, issue subpoenas, conduct searches, levy fines, and seek injunctions—all without the FTC’s say-so.”
