- Affirming conviction of possession of a firearm by a felon.
- The Court held there was no plain error in application of 18 U.S.C. § 922(g) under the Commerce Clause, holding that Circuit precedent is clear that the statute does not violate the Commerce Clause and that there is no Supreme Court precedent that unequivocally overrules it.
- The Court held that, although the Supreme Court announced a new analytical framework for Second Amendment challenges in Bruen, a call for extension of precedent is not viable on plain error review. The Court did call the issue of the constitutionality of § 922(g) under the Second Amendment and Bruen an “unsettled question.”
