- Affirming in part and reversing in part summary judgment dismissal of employees’ WARN Act claims against investment advisor of plaintiffs’ employer on violations of WARN Act.
- The Court affirmed the district court’s holding that the WARN Act claims did not entitle the plaintiffs to a trial by jury, and therefore affirming the more-deferential standard for summary judgment applied to the District Court where claims would be by a bench trial. The Court held that WARN Act claims were more analogous to breach-of-fiduciary duty claims than to quasi-contract claims.
- The Court reversed the district court’s grant of summary judgment dismissing claims against investment advisor of bankrupt employer, holding that, even under the more-deferential standard, there were genuine issues of material fact as to the control over the employer’s actions in terminating employees in violation of the WARN Act.
